1. About Our Service
Hawaiian Activities is a booking platform that helps travelers find and reserve discounted tours and activities across Oahu, Maui, the Big Island, and Kauai. We work with independent, third-party tour operators and activity providers throughout Hawaii, and bookings made through the Site are processed via our booking partners’ reservation systems. Hawaiian Activities does not itself operate, own, or directly supervise the tours, excursions, or activities listed on the Site — those services are provided by the independent operators named on each listing.
2. Bookings and Payment
When you book a tour or activity through the Site, you are entering into a direct contractual relationship with the third-party tour operator providing that activity. Prices, availability, and booking terms displayed on the Site are provided by our operator partners and are subject to change without notice until a booking is confirmed. Payment is processed at the time of booking through our secure third-party booking system. You are responsible for reviewing all booking details — including date, time, meeting location, and participant requirements — before confirming your reservation.
3. Cancellations and Refunds
Cancellation and refund policies vary by tour operator and are listed on each individual activity page. In general, most tours allow cancellation for a full refund when made a specified number of hours or days in advance of the scheduled activity, with reduced or no refunds for cancellations made closer to the activity date. Cancellations due to severe weather, safety concerns, or operator-initiated changes are typically handled with a full refund or free rescheduling. Please review the specific cancellation policy listed on the activity page at the time of booking, as it forms part of your agreement with the operator.
4. Assumption of Risk
Many activities listed on the Site — including but not limited to snorkeling, helicopter tours, volcano hikes, watersports, and other outdoor or adventure activities — carry inherent risks. By booking or participating in any activity found through the Site, you acknowledge and voluntarily assume all risks associated with that activity, including risks of injury, illness, property damage, or death. You are responsible for ensuring that you and any guests in your booking are physically able to safely participate, and for following all safety instructions provided by the tour operator.
5. Third-Party Operators and Services
The Site may contain links to, or integrate booking tools operated by, third parties, including tour operators and third-party reservation platforms. Hawaiian Activities does not control and is not responsible for the content, policies, availability, or conduct of these third parties. Your use of any third-party service is subject to that party’s own terms and privacy policy. Any disputes regarding the performance of a booked activity should be directed to the operator that provided the activity.
6. User Responsibilities
You agree to provide accurate and current information when making a booking, to use the Site only for lawful purposes, and not to interfere with the proper functioning of the Site. Some activities may have minimum age, health, or physical fitness requirements set by the operator; it is your responsibility to confirm that you and your travel party meet these requirements before booking.
7. Intellectual Property
All content on the Site, including text, graphics, logos, and images (excluding content owned by our operator partners or licensors), is the property of Hawaiian Activities or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written permission.
8. Limitation of Liability
To the fullest extent permitted by law, Hawaiian Activities and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Site or your participation in any activity booked through the Site. Because activities are performed by independent third-party operators, Hawaiian Activities is not liable for any injury, loss, or damage arising from the acts or omissions of those operators. Nothing in these Terms is intended to limit liability in ways not permitted under Hawaii or federal law.
9. Indemnification
You agree to indemnify and hold harmless Hawaiian Activities, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your participation in any activity booked through the Site.
